dal parivartan ke adhar par nirarhata ke bare mean upabandh

1. nirvachan-

is anusoochi mean jab tak ki sandarbh se anyatha apekshit n ho,-

(k) 'sadan' se, sansad ka koee sadan ya kisi rajy ki, yathasthiti, vidhan sabha ya, vidhan-mandal ka koee sadan abhipret hai;

(kh) sadan ke kisi aise sadasy ke sanbandh mean jo, yathasthiti, paira 2 ya paira 3 ya paira 4 ke upabandhoan ke anusar kisi rajanitik dal ka sadasy hai, 'vidhan-dal' se, us sadan ke aise sabhi sadasyoan ka samooh abhipret hai jo ukt upabandhoan ke anusar tatsamay us rajanitik dal ke sadasy haian;

(g) sadan ke kisi sadasy ke sanbandh mean, 'mool rajanitik dal' se aisa rajanitik dal abhipret hai jisaka vah paira 2 ke upapaira (1) ke prayojanoan ke lie sadasy hai;

(gh) 'paira' se is anusoochi ka paira abhipret hai.

2. dal parivartan ke adhar par nirarhata-

(1) paira 3, paira 4 aur paira 5 ke upabandhoan ke adhin rahate hue, sadan ka koee sadasy, jo kisi rajanitik dal ka sadasy hai, sadan ka sadasy hone ke lie us dasha mean nirarhit hoga jisamean[2]-

(k) usane aise rajanitik dal ki apani sadasyata svechchha se chho d di hai; ya

(kh) vah aise rajanitik dal dvara jisaka vah sadasy hai athava usake dvara is nimitt pradhikrit kisi vyakti ya pradhikari dvara die ge kisi nidesh ke viruddh, aise rajanitik dal, vyakti ya pradhikari ki poorv anujna ke bina, aise sadan mean matadan karata hai ya matadan karane se virat rahata hai aur aise matadan ya matadan karane se virat rahane ko aise rajanitik dal, vyakti ya pradhikari ne aise matadan ya matadan karane se virat rahane ki tarikh se pandrah din ke bhitar maph nahian kiya hai. spashtikaran- is upapaira ke prayojanoan ke lie, -

(k) sadan ke kisi nirvachit sadasy ke bare mean yah samajha jaega ki vah aise rajanitik dal ka, yadi koee ho, sadasy hai jisane use aise sadasy ke roop mean nirvachan ke lie abhyarthi ke roop mean kh da kiya tha;

(kh) sadan ke kisi namanirdeshit sadasy ke bare mean, -

(1) us dasha mean, jisamean vah aise sadasy ke roop mean apane namanirdeshan ki tarikh ko kisi rajanitik dal ka sadasy hai, yah samajha jaega ki vah aise rajanitik dal ka sadasy hai;

(2) kisi any dasha mean, yah samajha jaega ki vah us rajanitik dal ka sadasy hai jisaka, yathasthiti, anuchchhed 99 ya anuchchhed 188 ki apekshaoan ka anupalan karane ke pashchath‌ apana sthan grahan karane ki tarikh se chhah mas ki samapti ke poorv vah, yathasthiti, sadasy banata hai ya pahali bar banata hai.

(2) sadan ka koee nirvachit sadasy, jo kisi rajanitik dal dvara kh de kie ge abhyarthi se bhinn roop mean sadasy nirvachit hua hai, sadan ka sadasy hone ke lie nirarhit hoga yadi vah aise nirvachan ke pashchath‌ kisi rajanitik dal mean sammilit ho jata hai.

(3) sadan ka koee namanirdeshit sadasy, sadan ka sadasy hone ke lie nirarhit hoga yadi vah, yathasthiti, anuchchhed 99 ya anuchchhed 188 ki apekshaoan ka anupalan karane ke pashchath‌ apana sthan grahan karane ki tarikh se chhah mas ki samapti ke pashchath‌ kisi rajanitik dal mean sammilit ho jata hai.

(4) is paira ke poorvagami upabandhoan mean kisi bat ke hote hue bhi, kisi aise vyakti ke bare mean jo, sanvidhan (bavanavaan sanshodhan) adhiniyam, 1985 ke praranbh par, sadan ka sadasy hai (chahe vah nirvachit sadasy ho ya namanirdeshit) -

(1) us dasha mean, jisamean vah aise praranbh se thik pahale kisi rajanitik dal ka sadasy tha vahaan, is paira ke upapaira (1) ke prayojanoan ke lie, yah samajha jaega ki vah aise rajanitik dal dvara kh de kie ge abhyarthi ke roop mean aise sadan ka sadasy nirvachit hua hai;

(2) kisi any dasha mean, yathasthiti, is paira ke upapaira (2) ke prayojanoan ke lie, yah samajha jaega ki vah sadan ka aisa nirvachit sadasy hai jo kisi rajanitik dal dvara kh de kie ge abhyarthi se bhinn roop mean sadasy nirvachit hua hai ya, is paira ke upapaira (3) ke prayojanoan ke lie, yah samajha jaega ki vah sadan ka namanirdeshit sadasy hai.

3. dal parivartan ke adhar par nirarhata ka dal vibhajan ki dasha mean lagoo n hona-

jahaan sadan ka koee sadasy yah dava karata hai ki vah aur usake vidhan-dal ke koee any sadasy aise gut ka pratinidhitv karane vala samooh gathit karate haian jo usake mool rajanitik dal ke vibhajan ke parinamasvaroop utpanna hua hai aur aise samooh mean aise vidhan-dal ke kam se kam ek tihaee sadasy haian

vahaan -

(k) vah paira 2 ke upapaira (1) ke adhin is adhar par nirarhit nahian hoga ki-

(1) usane apane mool rajanitik dal ki apani sadasyata svechchha se chho d di hai; ya

(2) usane aise dal dvara athava usake dvara is nimitt pradhikrit kisi vyakti ya pradhikari dvara die ge kisi nidesh ke viruddh, aise dal, vyakti ya pradhikari ki poorv anujna ke bina, aise sadan mean matadan kiya hai ya vah matadan karane se virat raha hai aur aise matadan ya matadan karane se virat rahane ko aise dal, vyakti ya pradhikari ne aise matadan ya matadan karane se virat rahane ki tarikh se pandrah din ke bhitar maph nahian kiya hai; aur

(kh) aise dal vibhajan ke samay se, aise gut ke bare mean yah samajha jaega ki vah, paira 2 ke upapaira (1) ke prayojanoan ke lie, aisa rajanitik dal hai jisaka vah sadasy hai aur vah is paira ke prayojanoan ke lie usaka mool rajanitik dal hai.

4. dal parivartan ke adhar par nirarhata ka vilay ki dasha mean lagoo n hona-

(1) sadan ka koee sadasy paira 2 ke upapaira (1) ke adhin nirarhit nahian hoga yadi usake mool rajanitik dal ka kisi any rajanitik dal mean vilay ho jata hai aur vah yah dava karata hai ki vah aur uke mool rajanitik dal ke any sadasy-

(k) yathasthiti, aise any rajanitik dal ke ya aise vilay se bane ne rajanitik dal ke sadasy ban ge haian; ya

(kh) unhoanne vilay svikar nahian kiya hai aur ek prithakh‌ samooh ke rup mean kary karane ka vinishchay kiya hai, aur aise vilay ke samay se, yathasthiti, aise any rajanitik dal ya ne rajanitik dal ya samooh ke bare mean yah samajha jaega ki vah, paira 2 ke upapaira (1) ke prayojanoan ke lie, aisa rajanitik dal hai jisaka vah sadasy hai aur vah is upapaira ke prayojanoan ke lie usaka mool rajanitik dal hai.

(2) is paira ke upapaira (1) ke prayojanoan ke lie, sadan ke kisi sadasy ke mool rajanitik dal ka vilay hua tabhi samajha jaega jab sanbandhit vidhan-dal ke kam se kam do tihaee sadasy aise vilay ke lie sahamat ho ge haian.

5. chhoot-

is anusoochi mean kisi bat ke hote hue bhi, koee vyakti, jo lok sabha ke adhyaksh ya upadhyaksh athava rajy sabha ke upasabhapati athava kisi rajy ki vidhan parishadh ke sabhapati ya upasabhapati athava kisi rajy ki vidhan sabha ke adhyaksh ya upadhyaksh ke pad par nirvachit hua hai, is anusoochi ke adhin nirarhit nahian hoga,-

(k) yadi vah, aise pad par apane nirvachan ke karan aise rajanitik dal ki jisaka vah aise nirvachan se thik pahale sadasy tha, apani sadasyata svechchha se chho d deta hai aur usake pashchath‌ jab tak vah pad dharan kie rahata hai tab tak, us rajanitik dal mean punah sammilit nahian hota hai ya kisi doosare rajanitik dal ka sadasy nahian banata hai; ya

(kh) yadi vah, aise pad par apane nirvachan ke karan, aise rajanitik dal ki jisaka vah aise nirvachan se thik pahale sadasy tha, apani sadasyata chho d deta hai aur aise pad par n rah jane ke pashchath‌ aise rajanitik dal mean punah sammilit ho jata hai.

6. dal parivartan ke adhar par nirarhata ke bare mean prashnoan ka vinishchay-

(1) yadi yah prashn uthata hai ki sadan ka koee sadasy is anusoochi ke adhin nirarhata se grast ho gaya hai ya nahian to vah prashn, aise sadan ke, yathasthiti, sabhapati ya adhyaksh ke vinishchay ke lie nirdeshit kiya jaega aur usaka vinishchay aantim hoga: parantu jahaan yah prashn uthata hai ki sadan ka sabhapati ya adhyaksh nirarhata se grast ho gaya hai ya nahian vahaan vah prashn sadan ke aise sadasy ke vinishchay ke lie nirdeshit kiya jaega jise vah sadan is nimitt nirvachit kare aur usaka vinishchay aantim hoga.

(2) is anusoochi ke adhin sadan ke kisi sadasy ki nirarhata ke bare mean kisi prashn ke sanbandh mean is paira ke upapaira (1) ke adhin sabhi karyavahiyoan ke bare mean yah samajha jaega ki ve, yathasthiti, anuchchhed 122 ke arth mean sansad ki karyavahiyaan haian ya anuchchhed 212 ke arth mean rajy ke vidhan-mandal ki karyavahiyaan haian.

7. nyayalayoan ki adhikarita ka varjan-

is sanvidhan mean kisi bat ke hote hue bhi, kisi nyayalay ko is anusoochi ke adhin sadan ke kisi sadasy ki nirarhata se sanbandhit kisi vishay ke bare mean koee adhikarita nahian hogi.[3]

8. niyam-

(1) is paira ke upapaira (2) ke upabandhoan ke adhin rahate hue, sadan ka sabhapati ya adhyaksh, is anusoochi ke upabandhoan ko karyanvit karane ke lie niyam bana sakega tatha vishishtataya aur poorvagami shakti ki vyapakata par pratikool prabhav dale bina, aise niyamoan mean nimnalikhit ke lie upabandh kiya ja sakega, arthath‌ :-

(k) sadan ke vibhinn sadasy jin rajanitik daloan ke sadasy haian, unake bare mean rajistar ya any abhilekh rakhana;

(kh) aisa prativedan jo sadan ke kisi sadasy ke sanbandh mean vidhan-dal ka neta, us sadasy ki babat paira 2 ke upapaira (1) ke khand (kh) mean nirdisht prakriti ki maphi ke sanbandh mean dega, vah samay jisake bhitar aur vah pradhikari jisako aisa prativedan diya jaega.

(g) aise prativedan jinhean koee rajanitik dal sadan ke kisi sadasy ko aise rajanitik dal mean pravisht karane ke sanbandh mean dega aur sadan ka aisa adhikari jisako aise prativedan die jaeange; aur

(gh) paira 6 ke upapaira (1) mean nirdisht kisi prashn ka vinishchay karane ki prakriya jisake aantargat aisi jaanch ki prakriya hai, jo aise prashn ka vinishchay karane ke prayojan ke lie ki jae.

(2) sadan ke sabhapati ya adhyaksh dvara is paira ke upapaira (1) ke adhin banae ge niyam, banae jane ke pashchath‌ yathashighr, sadan ke samaksh, kul tis din ki avadhi ke lie rakhe jaeange. yah avadhi ek satr mean athava do ya adhik anukramik satroan mean poori ho sakegi.

(3) sadan ka sabhapati ya adhyaksh, yathasthiti, anuchchhed 105 ya anuchchhed 194 ke upabandhoan par aur kisi aisi any shakti par jo use is sanvidhan ke adhin prapt hai, pratikool prabhav dale bina, yah nidesh de sakega ki is paira ke adhin banae ge niyamoan ke kisi vyakti dvara janaboojhakar kie ge kisi ullanghan ke bare mean usi riti se karravaee ki jae jis riti se sadan ke visheshadhikar ke bhang ke bare mean ki jati hai.


tika tippani aur sandarbh

  1. sanvidhan (bavanavaan sanshodhan) adhiniyam, 1985 ki dhara 6 dvara (1-3-1985 se) jo da gaya.
  2. sanvidhan (ekyanavevaan sanshodhan) adhiniyam, 2003 ki dhara 5 dvara "ya paira 3" lop kiya gaya.
  3. paira 7 ko kihoto holohan banam jochilhu aur any (1992) 1 es.si.si. 309 mean bahumat ki ray ke anusar anuchchhed 368 ke khand (2) ke parantuk ke anusar adhisoochana ke abhav mean avidhimany ghoshit kiya gaya.
