vidhayi shaktiyoan ka vitaran

245. sansad dvara aur rajyoan ke vidhan-mandaloan dvara banaee gee vidhiyoan ka vistar--

(1) is sanvidhan ke upabandhoan ke adhin rahate hue, sansad bharat ke sanpoorn rajyakshetr ya usake kisi bhag ke lie vidhi bana sakegi aur kisi rajy ka vidhan-mandal sanpoorn rajy ya usake kisi bhag ke lie vidhi bana sakega.
(2) sansad dvara banaee gee koee vidhi is adhar par adhimany nahian samajhi jaegi ki usaka rajyakshetratit pravartan hoga.

246. sansad dvara aur rajyoan ke vidhan-mandaloan dvara banaee gee vidhiyoan ki vishay-vastu--

(1) khand (2) aur khand (3) mean kisi bat ke hote hue bhi, sansad ko satavian anusoochi ki soochi 1 mean (jise is sanvidhan mean sangh soochi kaha gaya hai) praganit kisi bhi vishay ke sanbandh mean vidhi banane ki anany shakti hai.
(2) khand (3) mean kisi bat ke hote hue bhi, sansad ko aur khand (1) ke adhin rahate hue, [1]kisi rajy ke vidhan-mandal ko bhi, satavian anusoochi ki soochi 3 mean (jise is sanvidhan mean samavarti soochi kaha gaya hai) praganit kisi bhi vishay ke sanbandh mean vidhi banane ki shakti hai.

(3) khand (1) aur khand (2) ke adhin rahate hue, [2] kisi rajy ke vidhan-mandal ko, satavian anusoochi ki soochi 2 mean (jise is sanvidhan mean rajy soochi kaha gaya hai) praganit kisi bhi vishay ke sanbandh mean us rajy ya usake kisi bhag ke lie vidhi banane ki anany shakti hai.
(4) sansad ko bharat ke rajyakshetr ke aise bhag ke lie [3][jo kisi rajy] ke aantargat nahian hai, kisi bhi vishay ke sanbandh mean vidhi banane ki shakti hai, chahe vah vishay rajy soochi mean praganit vishay hi kyoan n ho.

247. kuchh atirikt nyayalayoan ki sthapana ka upabandh karane ki sansad ki shakti--

is adhh‍yay mean kisi bat ke hote hue bhi, sansad apane dvara banaee gee vidhiyoan ke ya kisi vidyaman vidhi ke, jo sangh soochi mean praganit vishay ke sanbandh mean hai, adhik achchhe prashasan ke lie atirikt nyayalayoan ki sthapana ka vidhi dvara upabandh kar sakegi.

248. avashisht vidhayi shaktiyaan--

(1) sansad ko kisi aise vishay ke sanbandh mean, jo samavarti soochi ya rajy soochi mean praganit nahian hai, vidhi banane ki anany shakti hai.
(2) aisi shakti ke aantargat aise kar ke adhiropan ke lie jo un soochiyoan mean se kisi mean varnit nahian hai, vidhi banane ki shakti hai.

249. rajy soochi mean ke vishay ke sanbandh mean rashtriy hit mean vidhi banane ki sansad ki shakti--

(1) is adhh‍yay ke poorvagami upabandhoan mean kisi bat ke hote hue bhi, yadi rajy sabha ne upasthit aur mat dene vale sadasyoan mean se kam se kam do-tihaee sadasyoan dvara samarthit sankalp dvara ghoshit kiya hai ki rashtriy hit mean yah avashyak ya samichin hai ki sansad rajy soochi mean praganit aise vishay ke sanbandh mean, jo us sankalp mean vinirdisht hai, vidhi banae to jab tak vah sankalp pravritt hai, sansad ke lie us vishay ke sanbandh mean bharat ke sanpoorn rajyakshetr ya usake kisi bhag ke lie vidhi banana vidhipoorn hoga.
(2) khand (1) ke adhin parit sankalp ek varsh se anadhik aisi avadhi ke lie pravritt rahega jo usamean vinirdisht ki jae :
parantu yadi aur jitani bar kisi aise sankalp ko pravritt banae rakhane ka anumodan karane vala sankalp khand (1) mean upabandhit riti se parit ho jata hai to aur utani bar aisa sankalp us tarikh se, jisako vah is khand ke adhin anyatha pravritt nahian rahata, ek varsh ki aur avadhi tak pravritt rahega. (3) sansad dvara banaee gee koee vidhi, jise sansad khand (1) ke adhin sankalp ke parit hone ke abhav mean banane ke lie saksham nahian hoti, sankalp ke pravritt n rahane ke pashchath‌ chhah mas ki avadhi ki samapti par akshamata ki matra tak un batoan ke sivay prabhavi nahian rahegi jinhean ukt avadhi ki samapti se pahale kiya gaya hai ya karane ka lop kiya gaya hai.

250. yadi apat ki udh‌ghoshana pravartan mean ho to rajy soochi mean ke vishay ke sanbandh mean vidhi banane ki sansad ki shakti--

(1) is adhh‍yay mean kisi bat ke hote hue bhi, sansad ko, jab tak apat ki udh‌ghoshana pravartan mean hai, rajy soochi mean praganit kisi bhi vishay ke sanbandh mean bharat ke sanpoorn rajyakshetr ya usake kisi bhag ke lie vidhi banane ki shakti hogi.
(2) sansad dvara banaee gee koee vidhi, jise sansad apat ki udh‌ghoshana ke abhav mean banane ke lie saksham nahian hoti, udh‌ghoshana ke pravartan mean n rahane ke pashchath‌ chhah mas ki avadhi ki samapti par akshamata ki matra tak un batoan ke sivay prabhavi nahian rahegi jinhean ukt avadhi ki samapti se pahale kiya gaya hai ya karane ka lop kiya gaya hai.

251. sansad dvara anuchchhed 249 aur anuchchhed 250 ke adhin banaee gee vidhiyoan aur rajyoan ke vidhan-mandaloan dvara banaee gee vidhiyoan mean asangati--

anuchchhed 249 aur anuchchhed 250 ki koee bat kisi rajy ke vidhan-mandal ki aisi vidhi banane ki shakti ko, jise is sanvidhan ke adhin banane ki shakti usako hai, nirbandhit nahian karegi kiantu yadi kisi rajy ke vidhan-mandal dvara banaee gee vidhi ka koee upabandh sansad dvara banaee gee vidhi ke, jise ukt anuchchhedoan mean se kisi anuchchhed ke adhin banane ki shakti sansad ko hai, kisi upabandh ke viruddh hai to sansad dvara banaee gee vidhi abhibhavi hogi chahe vah rajy ke vidhan-mandal dvara banaee gee vidhi se pahale ya usake bad mean parit ki gee ho aur rajy ke vidhan-mandal dvara banaee gee vidhi us virodh ki matra tak apravartaniy hogi kiantu aisa tabhi tak hoga jab tak sansad dvara banaee gee vidhi prabhavi rahati hai.

252. do ya adhik rajyoan ke lie unaki sahamati se vidhi banane ki sansad ki shakti aur aisi vidhi ka kisi any rajy dvara aangikar kiya jana--

(1) yadi kinhian do ya adhik rajyoan ke vidhan-mandaloan ko yah vaanchhaniy pratit hota hai ki un vishayoan mean se, jinake sanbandh mean sansad ko anuchchhed 249 aur anuchchhed 250 mean yatha upabandhit ke sivay rajyoan ke lie vidhi banane ki shakti nahian hai, kisi vishay ka viniyaman aise rajyoan mean sansad vidhi dvara kare aur yadi un rajyoan ke vidhan-mandaloan ke sabhi sadan us ashay ke sankalp parit karate haian to us vishay ka tadanusar viniyaman karane ke lie koee adhiniyam parit karana sansad ke lie vidhipoorn hoga aur is prakar parit adhiniyam aise rajyoan ko lagoo hoga aur aise any rajy ko lagoo hoga, jo tatpashchath‌ apane vidhan-mandal ke sadan dvara ya jahaan do sadan haian vahaan donoan sadanoan mean se pratyek sadan is nimitt parit sankalp dvara usako aangikar kar leta hai.
(2) sansad dvara is prakar parit kisi adhiniyam ka sanshodhan ya nirasan isi riti se parit ya aangikrit sansad ke adhiniyam dvara kiya ja sakega, kiantu usaka us rajy ke sanbandh mean sanshodhan ya nirasan jisako vah lagoo hota hai, us rajy ke vidhan-mandal ke adhiniyam dvara nahian kiya jaega.

253. aantararashtriy kararoan ko prabhavi karane ke lie vidhan--

is adhyay ke poorvagami upabandhoan mean kisi bat ke hote hue bhi, sansad ko kisi any desh ya deshoan ke sath ki gee kisi sandhi, karar ya abhisamay athava kisi aantararashtriy sammelan, sangam ya any nikay mean kie ge kisi vinishchay ke karyanvayan ke lie bharat ke sanpoorn rajyakshetr ya usake kisi bhag ke lie koee vidhi banane ki shakti hai.

254. sansad dvara banaee gee vidhiyoan aur rajyoan ke vidhan-mandaloan dvara banaee gee vidhiyoan mean asangati--

(1) yadi kisi rajy ke vidhan-mandal dvara banaee gee vidhi ka koee upabandh sansad dvara banaee gee vidhi ke, jise adhiniyamit karane ke lie sansad saksham hai, kisi upabandh ke ya samavarti soochi mean praganit kisi vishay ke sanbandh mean vidyaman vidhi ke kisi upabandh ke viruddh hai to khand (2) ke upabandhoan ke adhin rahate hue, yathasthiti, sansad dvara banaee gee vidhi, chahe vah aise rajy ke vidhan-mandal dvara banaee gee vidhi se pahale ya usake bad mean parit ki gee ho, ya vidyaman vidhi, abhibhavi hogi aur us rajy ke vidhan-mandal dvara banaee gee vidhi us virodh ki matra tak shoony hogi.
(2) jahaan[4]rajy ke vidhan-mandal dvara samavarti soochi mean praganit kisi vishay ke sanbandh mean banaee gee vidhi mean koee aisa upabandh aantarvisht hai jo sansad dvara pahale banaee gee vidhi ke ya us vishay ke sanbandh mean kisi vidyaman vidhi ke upabandhoan ke viruddh hai to yadi aise rajy ke vidhan-mandal dvara is prakar banaee gee vidhi ko rashtrapati ke vichar ke lie arakshit rakha gaya hai aur us par usaki anumati mil gee hai to vah vidhi us rajy mean abhibhavi hogi :
parantu is khand ki koee bat sansad ko usi vishay ke sanbandh mean koee vidhi, jisake aantargat aisi vidhi hai, jo rajy ke vidhan-mandal dvara is prakar banaee gee vidhi ka parivardhan, sanshodhan, parivartan ya nirasan karati hai, kisi bhi samay adhiniyamit karane se nivarit nahian karegi.

255. sipharishoan aur poorv manjoori ke bare mean apekshaoan ko keval prakriya ke vishay manana--

yadi sansad ke ya [5] kisi rajy ke vidhan-mandal ke kisi adhiniyam ko--
(k) jahaan rajyapal ki sipharish apekshit thi vahaan rajyapal ya rashtrapati ne,
(kh) jahaan rajapramukh ki sipharish apekshit thi vahaan rajapramukh ya rashtrapati ne,
(g) jahaan rashtrapati ki sipharish ya poorv manjoori apekshit thi vahaan rashtrapati ne,
anumati de di hai to aisa adhiniyam aur aise adhiniyam ka koee upabandh keval is karan adhimany nahian hoga ki is sanvidhan dvara apekshit koee sipharish nahian ki gee thi ya poorv manjoori nahian di gee thi.

  1. sanvidhan (satavaan sanshodhan) adhiniyam, 1956 ki dhara 29 aur anusoochi dvara pahali anusoochi ke bhag k ya bhag kh mean vinirdisht shabdoan aur aksharoan ka lop kiya gaya.
  2. sanvidhan (satavaan sanshodhan) adhiniyam, 1956 ki dhara 29 aur anusoochi dvara pahali anusoochi ke bhag k ya bhag kh mean vinirdisht shabdoan aur aksharoan ka lop kiya gaya.
