vidhan sabha tatha vidhan parishad milakar vidhan mandal kahalate haian. bharatiy sanvidhan ke anusar rajyoan ke vidhan-mandaloan ka gathan is prakar kiya jata hai

  • (1) pratyek rajy ke lie ek vidhan-mandal hoga, jo rajyapal aur-
  • (2) jahaan kisi rajy ke vidhan-mandal ke do sadan haian, vahaan ek ka nam vidhan parishad aur doosare ka nam vidhan sabha hoga aur jahaan keval ek sadan hai, vahaan usaka nam vidhan sabha hoga.
169. rajyoan mean vidhan parishadoan ka utsadan ya srijan-
  • (1) anuchchhed 168 mean kisi bat ke hote hue bhi sansad vidhi dvara kisi vidhan parishad vale rajy mean vidhan parishad ke utsadan ke lie ya aise rajy mean, jisamean vidhan parishad nahian hai, vidhan parishad ke srijan ke lie upabandh kar sakegi, yadi us rajy ki vidhan sabha ne is ashay ka sankalp vidhan sabha ki kul sadasy sankhya ke bahumat dvara tatha upasthit aur mat dene vale sadasyoan ki sankhya ke kam se kam do-tihaee bahumat dvara parit kar diya hai.
  • (2) khand (1) mean vinirdisht kisi vidhi mean is sanvidhan ke sanshodhan ke lie aise upabandh aantarvisht hoange, jo us vidhi ke upabandhoan ko prabhavi karane ke lie avashyak hoan tatha aise anupoorak, anushangik aur parinamik upabandh bhi aantarvisht ho sakeange, jinhean sansad avashyak samajhe.
  • (3) poorvokt prakar ki koee vidhi anuchchhed 368 ke prayojanoan ke lie is sanvidhan ka sanshodhan nahian samajhi jaegi.
170. vidhan sabhaoan ki sanrachana-
  • (1) anuchchhed 333 ke upabandhoan ke adhin rahate hue, pratyek rajy ki vidhan sabha us rajy mean pradeshik nirvachan-kshetroan se pratyaksh nirvachan dvara chune hue paanch sau se anadhik aur sath se anyoon sadasyoan se milakar banegi.
  • (2) khand (1) ke prayojanoan ke lie, pratyek rajy ko pradeshik nirvachan-kshetroan mean aisi riti se vibhajit kiya jaega ki pratyek nirvachan-kshetr ki janasankhya ka usako abantit sthanoan ki sankhya se anupat samast rajy mean yathasadhy ek hi ho.[9]

is khand mean "janasankhya" pad se aisi aantim poorvavarti janaganana mean abhinishchit ki gee janasankhya abhipret hai, jisake susangat aank de prakashit ho ge haian, parantu is spashtikaran mean aantim poorvavarti janaganana ke prati jisake susangat aank de prakashit ho ge haian, nirdesh ka, jab tak san 2026[11] ke pashchath ki gee pahali janaganana ke susangat aank de prakashit nahian ho jate haian, yah arth lagaya jaega ki vah 2001[12] [13] ki janaganana ke pratinirdesh hai.

  • (3) pratyek janaganana ki samapti par pratyek rajy ki vidhan sabha mean sthanoan ki kul sankhya aur pratyek rajy ke pradeshik nirvachan kshetroan mean vibhajan ka aise pradhikari dvara aur aisi riti se pun:samayojan kiya jaega jo sansad vidhi dvara avadharit kare, parantu aise pun: samayojan se vidhan sabha mean pratinidhitv pad par tab tak koee prabhav nahian p dega, jab tak us samay vidyaman vidhan sabha ka vighatan nahian ho jata hai, [14]parantu yah aur ki aisa pun: samayojan us tarikh se prabhavi hoga, jo rashtrapati adesh dvara vinirdisht kare aur aise pun: samayojan ke prabhavi hone tak vidhan sabha ke lie koee nirvachan un pradeshik nirvachan-kshetroan ke adhar par ho sakega, jo aise pun: samayojan ke pahale vidyaman haian, parantu yah aur bhi ki jab tak san 2026[15] ke pashchath ki gee pahali janaganana ke susangat aank de prakashit nahian ho jate haian, tab tak is khand ke adhin,-

(i) pratyek rajy ki vidhan sabha mean 1971 ki janaganana ke adhar par pun: samayojit sthanoan ki kul sankhya ka, aur
(ii) aise rajy ke pradeshik nirvachan-kshetroan mean vibhajan ka, jo 2001[16] ki janaganana ke adhar par pun: samayojit kie jaean, pun: samayojan avashyak nahian hoga.[17]

171. vidhan parishadoan ki sanrachana-
  • (1) vidhan parishad vale rajy ki vidhan parishad ke sadasyoan ki kul sankhya us rajy ki vidhan sabha ke sadasyoan ki kul sankhya ke ek-tihaee[18] se adhik nahian hogi, parantu kisi rajy ki vidhan parishad ke sadasyoan ki kul sankhya kisi bhi dasha mean chalis se kam nahian hogi.
  • (2) jab tak sansad vidhi dvara anyatha upabandh n kare, tab tak kisi rajy ki vidhan parishad ki sanrachana khand (3) mean upabandhit riti se hogi.
  • (3) kisi rajy ki vidhan parishad ke sadasyoan ki kul sankhya ka-
    • (k) yathashaky nikatatam ek-tihaee bhag us rajy ki nagarapalikaoan, zila bordoan aur any aise sthaniy pradhikariyoan ke, jo sansad vidhi dvara vinirdisht kare, sadasyoan se milakar banane vale nirvachak-mandaloan dvara nirvachit hoga.
    • (kh) yathashaky nikatatam barahavaan bhag us rajy mean nivas karane vale aise vyaktiyoan se milakar banane vale nirvachak-mandaloan dvara nirvachit hoga, jo bharat ke rajyakshetr mean kisi vishvavidyalay ke kam se kam tin varsh se snatak haian ya jinake pas kam se kam tin varsh se aisi arhataean haian, jo sansad dvara banaee gee kisi vidhi ya usake adhin aise kisi vishvavidyalay ke snatak ki arhataoan ke samatuly vihit ki gee hoan.
    • (g) yathashaky nikatatam barahavaan bhag aise vyaktiyoan se milakar banane vale nirvachak-mandaloan dvara nirvachit hoga, jo rajy ke bhitar madhyamik pathashalaoan se animn star ki aisi shiksha sansthaoan mean, jo sansad dvara banaee gee kisi vidhi dvara ya usake adhin vihit ki jaean, padhane ke kam mean kam se kam tin varsh se lage hue haian.
    • (gh) yathashaky nikatatam ek-tihaee bhag rajy ki vidhan sabha ke sadasyoan dvara aise vyaktiyoan mean se nirvachit hoga, jo vidhan sabha ke sadasy nahian haian.
    • (n) shesh sadasy rajyapal dvara khand (5) ke upabandhoan ke anusar namanirdeshit kie jaeange.
  • (4) khand (3) ke upakhand (k), upakhand (kh) aur upakhand (g) ke adhin nirvachit hone vale sadasy aise pradeshik nirvachan-kshetroan mean chune jaeange, jo sansad dvara banaee gee vidhi dvara ya usake adhin vihit kie jaean tatha ukt upakhandoan ke aur ukt khand ke upakhand (gh) ke adhin nirvachan anupatik pratinidhitv paddhati ke anusar ekal sankramaniy mat dvara hoange.
  • (5) rajyapal dvara khand (3) ke upakhand (n) ke adhin namanirdeshit kie jane vale sadasy aise vyakti hoange, jinhean nimnalikhit vishayoan ke sanbandh mean vishesh jnan ya vyavaharik anubhav hai, arthat sahity, vijnan, kala, sahakari aandolan aur samaj seva.
172. rajyoan ke vidhan-mandaloan ki avadhi-
  • (1) pratyek rajy ki pratyek vidhan sabha, yadi pahale hi vighatit nahian kar di jati hai to, apane pratham adhiveshan ke lie niyat tarikh se paanch varsh[19] tak bani rahegi, isase adhik nahian aur paanch varsh[20] ki ukt avadhi ki samapti ka parinam vidhan sabha ka vighatan hoga, parantu ukt avadhi ko, jab apat ki udghoshana pravartan mean hai, tab sansad vidhi dvara aisi avadhi ke lie badha sakegi, jo ek bar mean ek varsh se adhik nahian hogi aur udghoshana ke pravartan mean n rah jane ke pashchath kisi bhi dasha mean usaka vistar chhah mas ki avadhi se adhik nahian hoga.
  • (2) rajy ki vidhan parishad ka vighatan nahian hoga, kiantu usake sadasyoan mean se yathasanbhav nikatatam ek-tihaee sadasy sansad dvara vidhi dvara is nimitt banae ge upabandhoan ke anusar, pratyek dvitiy varsh ki samapti par yathashaky shighr nivritt ho jaeange.
173. rajy ke vidhan-mandal ki sadasyata ke lie arhata-

koee vyakti kisi rajy mean vidhan-mandal ke kisi sthan ko bharane ke lie chune jane ke lie arhit tabhi hoga jab-

  • (k) vah bharat ka nagarik hai aur nirvachan ayog dvara is nimitt pradhikrit kisi vyakti ke samaksh tisari anusoochi mean is prayojan ke lie die ge praroop ke anusar shapath leta hai ya pratijnan karata hai aur us par apane hastakshar karata hai.[21]
  • (kh) vah vidhan sabha ke sthan ke lie kam se kam pachchis varsh ki ayu ka aur vidhan parishad ke sthan ke lie kam se kam tis varsh ki ayu ka hai.
  • (g) usake pas aisi any arhataean haian, jo is nimitt sansad dvara banaee gee kisi vidhi dvara ya usake adhin vihit ki jaean.
174. rajy ke vidhan-mandal ke satr, satravasan aur vighatan[22]-
  • (1) rajyapal samay-samay par rajy ke vidhan-mandal ke sadan ya pratyek sadan ko aise samay aur sthan par, jo vah thik samajhe, adhiveshan ke lie ahoot karega, kiantu usake ek satr ki aantim baithak aur agami satr ki pratham baithak ke lie niyat tarikh ke bich chhah mas ka aantar nahian hoga.
  • (2) rajyapal samay-samay par-
    • (k) sadan ka ya kisi sadan ka satravasan kar sakega.
    • (kh) vidhan sabha ka vighatan kar sakega.
175. sadan ya sadanoan mean abhibhashan ka aur unako sandesh bhejane ka rajyapal ka adhikar-
  • (1) rajyapal vidhan sabha mean ya vidhan parishad vale rajy ki dasha mean us rajy ke vidhan-mandal ke kisi ek sadan mean ya ek sath samavet donoan sadanoan mean, abhibhashan kar sakega aur is prayojan ke lie sadasyoan ki upasthiti ki apeksha kar sakega.
  • (2) rajyapal, rajy ke vidhan-mandal mean us samay lanbit kisi vidheyak ke sanbandh mean sandesh ya koee any sandesh, us rajy ke vidhan-mandal ke sadan ya sadanoan ko bhej sakega aur jis sadan ko koee sandesh is prakar bheja gaya hai, vah sadan us sandesh dvara vichar karane ke lie apekshit vishay par suvidhanusar shighrata se vichar karega.
176. rajyapal ka vishesh abhibhashan-
  • (1) rajyapal, vidhan sabha ke lie pratyek sadharan nirvachan ke pashchath pratham satr ke aranbh mean aur pratyek varsh ke pratham satr ke aranbh mean[23] vidhan sabha mean ya vidhan parishad vale rajy ki dasha mean ek sath samavet donoan sadanoan mean abhibhashan karega aur vidhan-mandal ko usake ahvan ke karan bataega.
  • (2) sadan ya pratyek sadan ki prakriya ka viniyaman karane vale niyamoan dvara aise abhibhashan mean nirdisht vishyoan ki charcha ke lie samay niyat karane ke lie (***)[24] upabandh kiya jaega.
177. sadanoan ke bare mean mantriyoan aur mahadhivakta ke adhikar-

pratyek mantri aur rajy ke mahadhivakta ko yah adhikar hoga ki vah us rajy ki vidhan sabha mean ya vidhan parishad vale rajy ki dasha mean donoan sadanoan mean bole aur unaki karyavahiyoan mean anyatha bhag le aur vidhan-mandal ki kisi samiti mean, jisamean usaka nam sadasy ke rooanp mean diya gaya hai, bole aur usaki karyavahiyoan mean anyatha bhag le, kintu is anuchchhed ke adhar par vah mat dene ka hakadar nahian hoga.

rajy ke vidhan-mandal ke adhikari

178. vidhan sabha ka adhyaksh aur upadhyaksh-

pratyek rajy ki vidhan sabha, yathashaky shighr apane do sadasyoan ko apana adhyaksh aur upadhyaksh chunegi aur jab-jab adhyaksh ya upadhyaksh ka pad rikt hota hai, tab-tab vidhan sabha kisi any sadasy ko, yathasthiti, adhyaksh ya upadhyaksh chunegi.

179. adhyaksh aur upadhyaksh ka pad rikt hona, padatyag aur pad se hataya jana-

vidhan sabha ke adhyaksh ya upadhyaksh ke rooanp mean pad dharan karane vala sadasy-

  • (k) yadi vidhan sabha ka sadasy nahian rahata hai to apana pad rikt kar dega.
  • (kh) kisi bhi samay, yadi vah sadasy adhyaksh hai to upadhyaksh ko sanbodhit aur yadi vah sadasy upadhyaksh hai to adhyaksh ko sanbodhit apane hastakshar sahit lekh dvara apana pad tyag sakega.
  • (g) vidhan sabha ke tatkalin samast sadasyoan ke bahumat se parit sankalp dvara apane pad se hataya ja sakega, parantu khand (g) ke prayojan ke lie koee sankalp tab tak prastavit nahian kiya jaega, jab tak ki us sankalp ko prastavit karane ke ashay ki kam se kam chaudah din ki soochana n de di gee ho, parantu yah aur ki jab kabhi vidhan sabha ka vighatan kiya jata hai to vighatan ke pashchath hone vale vidhan sabha ke pratham adhiveshan ke thik pahale tak adhyaksh apane pad ko rikt nahian karega.
180. adhyaksh ke pad ke kartavyoan ka palan karane ya adhyaksh ke rooanp mean kary karane ki upadhyaksh ya any vyakti ki shakti-
  • (1) jab adhyaksh ka pad rikt hai to upadhyaksh ya yadi upadhyaksh ka pad bhi rikt hai to vidhan sabha ka aisa sadasy, jisako rajyapal is prayojan ke lie niyukt kare, us pad ke kartavyoan ka palan karega.
  • (2) vidhan sabha ki kisi baithak se adhyaksh ki anupasthiti mean upadhyaksh ya yadi vah bhi anupasthit hai to aisa vyakti, jo vidhan sabha ki prakriya ke niyamoan dvara avadharit kiya jae ya yadi aisa koee vyakti upasthit nahian hai to aisa any vyakti, jo vidhan sabha dvara avadharit kiya jae, adhyaksh ke rooanp mean kary karega.
181. jab adhyaksh ya upadhyaksh ko pad se hatane ka koee sankalp vicharadhin hai, tab usaka pithasin n hona-
  • (1) vidhan sabha ki kisi baithak mean, jab adhyaksh ko usake pad se hatane ka koee sankalp vicharadhin hai, tab adhyaksh ya jab upadhyaksh ko usake pad se hatane ka koee sankalp vicharadhin hai, tab upadhyaksh, upasthit rahane par bhi, pithasin nahian hoga aur anuchchhed 180 ke khand (2) ke upabandh aisi pratyek baithak ke sanbandh mean vaise hi lagoo hoange, jaise vah us baithak ke sanbandh mean lagoo hote haian, jisase, yathasthiti, adhyaksh ya upadhyaksh anupasthit hai.
  • (2) jab adhyaksh ko usake pad se hatane ka koee sankalp vidhan sabha mean vicharadhin hai, tab usako vidhan sabha mean bolane aur usaki karyavahiyoan mean anyatha bhag lene ka adhikar hoga aur vah anuchchhed 189 mean kisi bat ke hote hue bhi, aise sankalp par ya aisi karyavahiyoan ke dauran kisi any vishay par prathamat: hi mat dene ka hakadar hoga, kiantu mat barabar hone ki dasha mean mat dene ka hakadar nahian hoga.
182. vidhan parishad ka sabhapati aur upasabhapati-

vidhan parishad vale pratyek rajy ki vidhan parishad, yathashighr, apane do sadasyoan ko apana sabhapati aur upasabhapati chunegi aur jab-jab sabhapati ya upasabhapati ka pad rikt hota hai, tab-tab parishad kisi any sadasy ko, yathasthiti, sabhapati ya upasabhapati chunegi.

183. sabhapati aur upasabhapati ka pad rikt hona, padatyag aur pad se hataya jana-

vidhan parishad ke sabhapati ya upasabhapati ke rooanp mean pad dharan karane vala sadasy-

  • (k) yadi vidhan parishad ka sadasy nahian rahata hai to apana pad rikt kar dega.
  • (kh) kisi bhi samay, yadi vah sadasy sabhapati hai to upasabhapati ko sanbodhit aur yadi vah sadasy upasabhapati hai to sabhapati ko sanbodhit apane hastakshar sahit lekh dvara apana pad tyag sakega.
  • (g) vidhan parishad ke tatkalin samast sadasyoan ke bahumat se parit sankalp dvara apane pad se hataya ja sakega, parantu khand (g) ke prayojan ke lie koee sankalp tab tak prastavit nahian kiya jaega, jab tak ki us sankalp ko prastavit karane ke ashay ki kam se kam chaudah din ki soochana n de di gee ho.
184. sabhapati ke pad ke kartavyoan ka palan karane ya sabhapati ke rooanp mean kary karane ki upasabhapati ya any vyakti ki shakti-
  • (1) jab sabhapati ka pad rikt hai, tab upasabhapati, yadi upasabhapati ka pad bhi rikt hai to vidhan parishad ka aisa sadasy, jisako rajyapal is prayojan ke lie niyukt kare, us pad ke kartavyoan ka palan karega.
  • (2) vidhan parishad ki kisi baithak se sabhapati ki anupasthiti mean upasabhapati, ya yadi vah bhi anupasthit hai to aisa vyakti, jo vidhan parishad ki prakriya ke niyamoan dvara avadharit kiya jae, ya yadi aisa koee vyakti upasthit nahian hai to aisa any vyakti, jo vidhan parishad dvara avadharit kiya jae, sabhapati ke rooanp mean kary karega.
185. jab sabhapati ya upasabhapati ko pad se hatane ka koee sankalp vicharadhin hai, tab usaka pithasin n hona-
  • (1) vidhan parishad ki kisi baithak mean, jab sabhapati ko usake pad se hatane ka koee sankalp vicharadhin hai, tab sabhapati ya jab upasabhapati ko usake pad se hatane ka koee sankalp vicharadhin hai, tab upasabhapati, upasthit rahane par bhi pithasin nahian hoga aur anuchchhed 184 ke khand (2) ke upabandh aisi pratyek baithak ke sanbandh mean vaise hi lagoo hoange, jaise ve us baithak ke sanbandh mean lagoo hote haian, jisase yathasthiti, sabhapati ya upasabhapati anupasthit hai.
  • (2) jab sabhapati ko usake pad se hatane ka koee sankalp vidhan parishad mean vicharadhin hai, tab usako vidhan parishad mean bolane aur usaki karyavahiyoan mean anyatha bhag lene ka adhikar hoga aur vah anuchchhed 189 mean kisi bat ke hote hue bhi, aise sankalp par ya aisi karyavahiyoan ke dauran kisi any vishay par prathamat: hi mat dene ka hakadar hoga, kiantu mat barabar hone ki dasha mean mat dene ka hakadar nahian hoga.
186. adhyaksh aur upadhyaksh tatha sabhapati aur upasabhapati ke vetan aur bhatte-

vidhan sabha ke adhyaksh aur upadhyaksh ko tatha vidhan parishad ke sabhapati aur upasabhapati ko, aise vetan aur bhattoan ka, jo rajy ka vidhan-mandal, vidhi dvara, niyat kare aur jab tak is nimitt is prakar upabandh nahian kiya jata hai, tab tak aise vetan aur bhattoan ka jo doosari anusoochi mean vinirdisht haian, sanday kiya jaega.

187. rajy ke vidhan-mandal ka sachivalay-
  • (1) rajy ke vidhan-mandal ke sadan ka ya pratyek sadan ka prithakh sachiviy karmacharivrind hoga, parantu vidhan parishad vale rajy ke vidhan-mandal ki dasha mean, is khand ki kisi bat ka yah arth nahian lagaya jaega ki vah aise vidhan-mandal ke donoan sadanoan ke lie sammilit padoan ke srijan ko nivarit karati hai.
  • (2) rajy ka vidhan-mandal, vidhi dvara, rajy ke vidhan-mandal ke sadan ya sadanoan ke sachiviy karmacharivriand mean bharti ka aur niyukt vyaktiyoan ki seva ki shartoan ka viniyaman kar sakega.
  • (3) jab tak rajy ka vidhan-mandal khand (2) ke adhin upabandh nahian karata hai, tab tak rajyapal, yathasthiti, vidhan sabha ke adhyaksh ya vidhan parishad ke sabhapati se paramarsh karane ke pashchath vidhan sabha ke ya vidhan parishad ke sachiviy karmacharivriand mean bharti ke aur niyukt vyaktiyoan ki seva ki shartoan ke viniyaman ke lie niyam bana sakega aur is prakar banae ge niyam ukt khand ke adhin banaee gee kisi vidhi ke upabandhoan ke adhin rahate hue, prabhavi hoange.

rajy ki vidhan sabha ya vidhan parishad ka pratyek sadasy apana sthan grahan karane se pahale, rajyapal ya usake dvara is nimitt niyukt vyakti ke samaksh, tisari anusoochi mean is prayojan ke lie die ge prarooanp ke anusar, shapath lega ya pratijnan karega aur us par apane hastakshar karega.

189. sadanoan mean matadan, riktiyoan ke hote hue bhi sadanoan ki kary karane ki shakti aur ganapoorti-
  • (1) is sanvidhan mean yatha anyatha upabandhit ke sivay, kisi rajy ke vidhan-mandal ke kisi sadan ki baithak mean sabhi prashnoan ka avadharan, adhyaksh ya sabhapati ko athava us rooanp mean kary karane vale vyakti ko chho dakar, upasthit aur mat dene vale sadasyoan ke bahumat se kiya jaega. adhyaksh ya sabhapati, athava us rooanp mean kary karane vala vyakti prathamat: mat nahian dega, kiantu mat barabar hone ki dasha mean usaka nirnayak mat hoga aur vah usaka prayog karega.
  • (2) rajy ke vidhan-mandal ke kisi sadan ki sadasyata mean koee rikti hone par bhi, us sadan ko kary karane ki shakti hogi aur yadi bad mean yah pata chalata hai ki koee vyakti, jo aisa karane ka hakadar nahian tha, karyavahiyoan mean upasthit raha hai ya usane mat diya hai ya anyatha bhag liya hai to bhi rajy ke vidhan-mandal ki karravaee vidhimany hogi.
  • (3) jab tak rajy ka vidhan-mandal vidhi dvara anyatha upabandh n kare, tab tak rajy ke vidhan-mandal ke kisi sadan ka adhiveshan gathit karane ke lie ganapoorti das sadasy ya sadan ke sadasyoan ki kul sankhya ka dasavaan bhag, isamean se jo bhi adhik ho, hogi.

sadasyoan ki nirarhataean

190. sthanoan ka rikt hona-
  • (1) koee vyakti rajy ke vidhan-mandal ke donoan sadanoan ka sadasy nahian hoga aur jo vyakti donoan sadanoan ka sadasy chun liya jata hai, usake ek ya doosare sadan ke sthan ko rikt karane ke lie us rajy ka vidhan-mandal vidhi dvara upabandh karega.
  • (2) koee vyakti pahali anusoochi mean vinirdisht do ya adhik rajyoan ke vidhan-mandaloan ka sadasy nahian hoga aur yadi koee vyakti do ya adhik aise rajyoan ke vidhan-mandaloan ka sadasy chun liya jata hai to aisi avadhi ki samapti ke pashchath jo rashtrapati dvara banae ge niyamoan[25] mean vinirdisht ki jae, aise sabhi rajyoan ke vidhan-mandaloan mean aise vyakti ka sthan rikt ho jaega, yadi usane ek rajy ko chho dakar any rajyoan ke vidhan-mandaloan mean apane sthan ko pahale hi nahian tyag diya hai.
  • (3) yadi rajy ke vidhan-mandal ke kisi sadan ka sadasy-
    • (k) anuchchhed 191 ke khand (2)[26] mean varnit kisi nirarhata se grast ho jata hai, ya
    • (kh) yathasthiti, adhyaksh ya sabhapati ko sanbodhit apane hastakshar sahit lekh dvara apane sthan ka tyag kar deta hai aur usaka tyagapatr, yathasthiti, adhyaksh ya sabhapati dvara svikar kar liya jata hai[27] to aisa hone par usaka sthan rikt ho jaega, parantu upakhand (kh) mean nirdisht tyagapatr ki dasha mean, yadi prapt janakari se ya anyatha aur aisi jaanch karane ke pashchath, jo vah thik samajhe, yathasthiti, adhyaksh ya sabhapati ka yah samadhan ho jata hai ki aisa tyagapatr svaichchhik ya asali nahian hai to vah aise tyagapatr ko svikar nahian karega.[28]
  • (4) yadi kisi rajy ke vidhan-mandal ke kisi sadan ka sadasy sath din ki avadhi tak sadan ki anujna ke bina usake sabhi adhiveshanoan se anupasthit rahata hai to sadan usake sthan ko rikt ghoshit kar sakega, parantu sath din ki ukt avadhi ki sanganana karane mean kisi aisi avadhi ko hisab mean nahian liya jaega, jisake dauran sadan satravasit ya nirantar char se adhik dinoan ke lie sthagit rahata hai.
191. sadasyata ke lie nirarhataean-
  • (1) koee vyakti kisi rajy ki vidhan sabha ya vidhan parishad ka sadasy chune jane ke lie aur sadasy hone ke lie nirarhit hoga-
    • (k) yadi vah bharat sarakar ke ya pahali anusoochi mean vinirdisht kisi rajy ki sarakar ke adhin, aise pad ko chho dakar jisako dharan karane vale ka nirarhit n hona rajy ke vidhan-mandal ne vidhi dvara ghoshit kiya hai, koee labh ka pad dharan karata hai.
    • (kh) yadi vah vikritachitt hai aur saksham nyayalay ki aisi ghoshana vidyaman hai.
    • (g) yadi vah anunmochit divaliya hai.
    • (gh) yadi vah bharat ka nagarik nahian hai ya usane kisi videshi rajy ki nagarikata svechchha se arjit kar li hai ya vah kisi videshi rajy ke prati nishtha ya anushakti ko abhisvikar kie hue hai.
    • (n) yadi vah sansad dvara banaee gee kisi vidhi dvara ya usake adhin is prakar nirarhit kar diya jata hai.


spashtikaran - is khand ke prayojanoan ke lie[29] koee vyakti keval is karan bharat sarakar ke ya pahali anusoochi mean vinirdisht kisi rajy ki sarakar ke adhin labh ka pad dharan karane vala nahian samajha jaega ki vah sangh ka ya aise rajy ka mantri hai.

  • (2) koee vyakti kisi rajy ki vidhan sabha ya vidhan parishad ka sadasy hone ke lie nirarhit hoga, yadi vah dasavian anusoochi ke adhin is prakar nirarhit ho jata hai.[30]
192. sadasyoan ki nirarhataoan se sanbandhit prashnoan par vinishchay-
  • (1) yadi yah prashn uthata hai ki kisi rajy ke vidhan-mandal ke kisi sadan ka koee sadasy anuchchhed 191 ke khand (1) mean varnit kisi nirarhata se grast ho gaya hai ya nahian to vah prashn rajyapal ko vinishchay ke lie nirdeshit kiya jaega aur usaka vinishchay aantim hoga.
  • (2) aise kisi prashn par vinishchay karane se pahale rajyapal nirvachan ayog ki ray lega aur aisi ray ke anusar kary karega.[31]
193. anuchchhed 188 ke adhin shapath lene ya pratijna karane se pahale ya arhit n hote hue ya nirarhit kie jane par baithane aur mat dene ke lie shasti-

yadi kisi rajy ki vidhan sabha ya vidhan parishad mean koee vyakti anuchchhed 188 ki apekshaoan ka anupalan karane se pahale, ya yah janate hue ki maian usaki sadasyata ke lie arhit nahian hooan ya nirarhit kar diya gaya hooan ya sansad ya rajy ke vidhan-mandal dvara banaee gee kisi vidhi ke upabandhoan dvara aisa karane se pratishiddh kar diya gaya hooan, sadasy ke rooanp mean baithata hai ya mat deta hai to vah pratyek din ke lie jab vah is prakar baithata hai ya mat deta hai, paanch sau ruanpe ki shasti ka bhagi hoga, jo rajy ko dey rrin ke rooanp mean vasool ki jaegi.

194. vidhan-mandaloan ke sadanoan ki tatha unake sadasyoan aur samitiyoan ki shaktiyaan, visheshadhikar, adi-
  • (1) is sanvidhan ke upabandhoan ke aur vidhan-mandal ki prakriya ka viniyaman karane vale niyamoan aur sthayi adeshoan ke adhin rahate hue, pratyek rajy ke vidhan-mandal mean vakh-svatantry hoga.
  • (2) rajy ke vidhan-mandal mean ya usaki kisi samiti mean vidhan-mandal ke kisi sadasy dvara kahi gee kisi bat ya die ge kisi mat ke sanbandh mean usake viruanddh kisi nyayalay mean koee karravaee nahian ki jaegi aur kisi vyakti ke viruddh aise vidhan-mandal ke kisi sadan ke pradhikar dvara ya usake adhin kisi prativedan patr, matoan ya karyavahiyoan ke prakashan ke sanbandh mean is prakar ki koee karravaee nahian ki jaegi.
  • (3) any batoan mean rajy ke vidhan-mandal ke kisi sadan ki aur aise vidhan-mandal ke kisi sadan ke sadasyoan aur samitiyoan ki shaktiyaan, visheshadhikar aur unmuktiyaan aisi hoangi, jo vah vidhan-mandal, samay-samay par, vidhi dvara parinishchit karean aur jab tak ve is prakar parinishchit nahian ki jati haian, tab tak vahi hoangi, jo sanvidhan (chavalisavaan sanshodhan) adhiniyam, 1978 ki dhara 26 ke pravritt hone se thik pahale us sadan ki aur usake sadasyoan aur samitiyoan ki thian.[32]
  • (4) jin vyaktiyoan ko is sanvidhan ke adhar par rajy ke vidhan-mandal ke kisi sadan ya usaki kisi samiti mean bolane ka aur usaki karyavahiyoan mean anyatha bhag lene ka adhikar hai, unake sanbandh mean khand (1), khand (2) aur khand (3) ke upabandh usi prakar lagoo hoange, jis prakar ve us vidhan-mandal ke sadasyoan ke sanbandh mean lagoo hote haian.
195. sadasyoan ke vetan aur bhatte-

rajy ki vidhan sabha aur vidhan parishad ke sadasy aise vetan aur bhatte, jinhean us rajy ka vidhan-mandal, samay-samay pad, vidhi dvara, avadharit kare aur jab tak is sanbandh mean is prakar upabandh nahian kiya jata hai, tab tak aise vetan aur bhatte, aisi daroan se aur aisi shartoan par, jo tatsthani praant ki vidhan sabha ke sadasyoan ko is sanvidhan ke praranbh se thik pahale lagoo thian, prapt karane ke hakadar hoange.

196. vidheyakoan ke purnasthapan aur parit kie jane ke sanbandh mean upabandh-
  • (1) dhan vidheyakoan aur any vitt vidheyakoan ke sanbandh mean anuchchhed 198 aur anuchchhed 207 ke upabandhoan ke adhin rahate hue, koee vidheyak vidhan parishad vale rajy ke vidhan-mandal ke kisi bhi sadan mean aranbh ho sakega.
  • (2) anuchchhed 197 aur anuchchhed 198 ke upabandhoan ke adhin rahate hue, koee vidheyak vidhan parishad vale rajy ke vidhan-mandal ke sadanoan dvara tab tak parit kiya gaya nahian samajha jaega, jab tak sanshodhan ke bina ya keval aise sanshodhanoan sahit, jin par donoan sadan sahamat ho ge haian, us par donoan sadan sahamat nahian ho jate haian.
  • (3) kisi rajy ke vidhanamandal mean lanbit vidheyak usake sadan ya sadanoan ke satravasan ke karan vyapagat nahian hoga.
  • (4) kisi rajy ki vidhan parishad mean lanbit vidheyak, jisako vidhan sabha ne parit nahian kiya hai, vidhan sabha ke vighatan par vyapagat nahian hoga.
  • (5) koee vidheyak, jo kisi rajy ki vidhan sabha mean lanbit hai ya jo vidhan sabha dvara parit kar diya gaya hai aur vidhan parishad mean lanbit hai, vidhan sabha ke vighatan par vyapagat ho jaega.
197. dhan vidheyakoan se bhinn vidheyakoan ke bare mean vidhan parishad ki shaktiyoan par nirbandhan-
  • (1) yadi vidhan parishad vale rajy ki vidhan sabha dvara kisi vidheyak ke parit kie jane aur vidhan parishad ko pareshit kie jane ke pashchath-
    • (k) vidhan parishad dvara vidheyak asvikar kar diya jata hai, ya
    • (kh) vidhan parishad ke samaksh vidheyak rakhe jane ki tarikh se, usake dvara vidheyak parit kie bina, tin mas se adhik bit ge haian, ya
    • (g) vidhan parishad dvara vidheyak aise sanshodhanoan sahit parit kiya jata hai, jinase vidhan sabha sahamat nahian hoti hai, to vidhan sabha vidheyak ko, apani prakriya ka viniyaman karane vale niyamoan ke adhin rahate hue, usi ya kisi pashchatavarti satr mean aise sanshodhanoan sahit ya usake bina, yadi koee hoan, jo vidhan parishad ne kie haian, sujhae haian ya jinase vidhan parishad sahamat hai, pun:parit kar sakegi aur tab is prakar parit vidheyak ko vidhan parishad ko pareshit kar sakegi.
  • (2) yadi vidhan sabha dvara vidheyak is prakar dubara parit kar die jane aur vidhan parishad ko pareshit kie jane ke pashchath-
    • (k) vidhan parishad dvara vidheyak asvikar kar diya jata hai, ya
    • (kh) vidhan parishad ke samaksh vidheyak rakhe jane ki tarikh se, usake dvara vidheyak parit kie bina, ek mas se adhik bit gaya hai, ya
    • (g) vidhan parishad dvara vidheyak aise sanshodhanoan sahit parit kiya jata hai, jinase vidhan sabha sahamat nahian hoti hai, to vidheyak rajy ke vidhan-mandal ke sadanoan dvara aise sanshodhanoan sahit, yadi koee hoan, jo vidhan parishad ne kie haian ya sujhae haian aur jinase vidhan sabha sahamat hai, us rooanp mean parit kiya gaya samajha jaega, jisamean vah vidhan sabha dvara dubara parit kiya gaya tha.
  • (3) is anuchchhed ki koee bat dhan vidheyak ko lagoo nahian hogi.
198. dhan vidheyakoan ke sanbandh mean vishesh prakriya-
  • (1) dhan vidheyak vidhan parishad mean pur:sthapit nahian kiya jaega.
  • (2) dhan vidheyak vidhan parishad vale rajy ki vidhan sabha dvara parit kie jane ke pashchath vidhan parishad ko usaki sipharishoan ke lie pareshit kiya jaega aur vidhan parishad vidheyak ki prapti ki tarikh se chaudah din ki avadhi ke bhitar vidheyak ko apani sipharishoan sahit vidhan sabha ko lauta degi aur aisa hone par vidhan sabha, vidhan parishad ki sabhi ya kinhian sipharishoan ko svikar ya asvikar kar sakegi.
  • (3) yadi vidhan sabha, vidhan parishad ki kisi sipharish ko svikar kar leti hai to dhan vidheyak vidhan parishad dvara sipharish kie ge aur vidhan sabha dvara svikar kie ge sanshodhanoan sahit donoan sadanoan dvara parit kiya gaya samajha jaega.
  • (4) yadi vidhan sabha, vidhan parishad ki kisi bhi sipharish ko svikar nahian karati hai to dhan vidheyak vidhan parishad dvara sipharish kie ge kisi sanshodhan ke bina, donoan sadanoan dvara us rooanp mean parit kiya gaya samajha jaega, jisamean vah vidhan sabha dvara parit kiya gaya tha.
  • (5) yadi vidhan sabha dvara parit aur vidhan parishad ko usaki sipharishoan ke lie pareshit dhan vidheyak ukt chaudah din ki avadhi ke bhitar vidhan sabha ko nahian lautaya jata hai to ukt avadhi ki samapti par vah donoan sadanoan dvara us rooanp mean parit kiya gaya samajha jaega, jisamean vah vidhan sabha dvara parit kiya gaya tha.
199. "dhan vidheyak" ki paribhasha-
  • (1) is adhyay ke prayojanoan ke lie, koee vidheyak dhan vidheyak samajha jaega, yadi usamean keval nimnalikhit sabhi ya kinhian vishayoan se sanbandhit upabandh haian, arthath-
    • (k) kisi kar ka adhiropan, utsadan, parihar, parivartan ya viniyaman.
    • (kh) rajy dvara dhan udhar lene ka ya koee pratyabhooti dene ka viniyaman athava rajy dvara apane ooanpar li gee ya li jane vali kinhian vittiy badhyataoan se sanbandhit vidhi ka sanshodhan.
    • (g) rajy ki sanchit nidhi ya akasmikata nidhi ki abhiraksha, aisi kisi nidhi mean dhan jama karana ya usamean se dhan nikalana.
    • (gh) rajy ki sanchit nidhi mean se dhan ka viniyog.
    • (n) kisi vyay ko rajy ki sanchit nidhi par bharit vyay ghoshit karana ya aise kisi vyay ki rakam ko badhana.
    • (ch) rajy ki sanchit nidhi ya rajy ke lok lekhe maddhe dhan prapt karana athava aise dhan ki abhiraksha ya usaka nirgaman; ya
    • (chh) upakhand (k) se upakhand (ch) mean vinirdisht kisi vishay ka anushangik koee vishay.
  • (2) koee vidheyak keval is karan dhan vidheyak nahian samajha jaega ki vah jurmanoan any dhaniy shastiyoan ke adhiropan ka athava anujnaptiyoan ke lie phisoan ki ya ki gee sevaoan ke lie phisoan ki maang ka ya unake sanday ka upabandh karata hai athava is karan dhan vidheyak nahian samajha jaega ki vah kisi sthaniy pradhikari ya nikay dvara sthaniy prayojanoan ke lie kisi kar ke adhiropan, utsadan, parihar, parivartan ya viniyaman ka upabandh karata hai.
  • (3) yadi yah prashn uthata hai ki vidhan parishad vale kisi rajy ke vidhan-mandal mean pur:sthapit koee vidheyak dhan vidheyak hai ya nahian to us par us rajy ki vidhan sabha ke adhyaksh ka vinishchay aantim hoga.
  • (4) jab dhan vidheyak anuchchhed 198 ke adhin vidhan parishad ko pareshit kiya jata hai aur jab vah anuchchhed 200 ke adhin anumati ke lie rajyapal ke samaksh prastut kiya jata hai, tab pratyek dhan vidheyak par vidhan sabha ke adhyaksh ke hastakshar sahit yah praman prishthaankit kiya jaega ki vah dhan vidheyak hai.
200. vidheyakoan par anumati-

jab koee vidheyak rajy ki vidhan sabha dvara ya vidhan parishad vale rajy mean vidhan-mandal ke donoan sadanoan dvara parit kar diya gaya hai, tab vah rajyapal ke samaksh prastut kiya jaega aur rajyapal ghoshit karega ki vah vidheyak par anumati deta hai ya anumati rok leta hai athava vah vidheyak ko rashtrapati ke vichar ke lie arakshit rakhata hai, parantu rajyapal anumati ke lie apane samaksh vidheyak prastut kie jane ke pashchath yathashighr us vidheyak ko, yadi vah dhan vidheyak nahian hai to, sadan ya sadanoan ko is sandesh ke sath lauta sakega ki sadan ya donoan sadan vidheyak par ya usake kinhian vinirdisht upabandhoan par punarvichar karean aur vishishtataya kinhian aise sanshodhanoan ke pur:sthapan ki vaanchhaniyata par vichar karean, jinaki usane apane sandesh mean sipharish ki hai aur jab vidheyak is prakar lauta diya jata hai, tab sadan ya donoan sadan vidheyak par tadanusar punarvichar kareange aur yadi vidheyak sadan ya sadanoan dvara sanshodhan sahit ya usake bina phir se parit kar diya jata hai aur rajyapal ke samaksh anumati ke lie prastut kiya jata hai to rajyapal us par anumati nahian rokega, parantu yah aur ki jis vidheyak se, usake vidhi ban jane par, rajyapal ki ray mean uchch nyayalay ki shaktiyoan ka aisa alpikaran hoga ki vah sthan, jisaki poorti ke lie vah nyayalay is sanvidhan dvara parikalpit hai, sankatapann ho jaega, us vidheyak par rajyapal anumati nahian dega, kiantu use rashtrapati ke vichar ke lie arakshit rakhega.

201. vichar ke lie arakshit vidheyak-

jab koee vidheyak rajyapal dvara rashtrapati ke vichar ke lie arakshit rakh liya jata hai tab rashtrapati ghoshit karega ki vah vidheyak par anumati deta hai ya anumati rok leta hai, parantu jahaan vidheyak dhan vidheyak nahian hai, vahaan rashtrapati rajyapal ko yah nidesh de sakega ki vah vidheyak ko, yathasthiti, rajy ke vidhan-mandal ke sadan ya sadanoan ko aise sandesh ke sath, jo anuchchhed 200 ke pahale parantuk mean varnit hai, lauta de aur jab koee vidheyak is prakar lauta diya jata hai, tab aisa sandesh milane ki tarikh se chh: mas ki avadhi ke bhitar sadan ya sadanoan dvara us par tadanusar punarvichar kiya jaega aur yadi vah sadan ya sadanoan dvara sanshodhan sahit ya usake bina phir se parit kar diya jata hai to use rashtrapati ke samaksh usake vichar ke lie phir se prastut kiya jaega.

vittiy vishayoan ke sanbandh mean prakriya

202. varshik vittiy vivaran-
  • (1) rajyapal pratyek vittiy varsh ke sanbandh mean rajy ke vidhan-mandal ke sadan ya sadanoan ke samaksh us rajy ki us varsh ke lie prakkalit praptiyoan aur vyay ka vivaran rakhavaega, jise is bhag "varshik vittiy vivaran" kaha gaya hai.
  • (2) varshik vittiy vivaran mean die hue vyay ke prakkalanoan mean-
    • (k) is sanvidhan mean rajy ki sanchit nidhi par bharit vyay ke rooanp mean varnit vyay ki poorti ke lie apekshit rashiyaan aur
    • (kh) rajy ki sanchit nidhi mean se kie jane ke lie prasthapit any vyay ki poorti ke lie apekshit rashiyaan, prithak-prithakh dikhaee jaeangi aur rajasv lekhe hone vale vyay ka any vyay se bhed kiya jaega.
  • (3) nimnalikhit vyay pratyek rajy ki sanchit nidhi par bharit vyay hoga, arthat-
    • (k) rajyapal ki upalabdhiyaan aur bhatte tatha usake pad se sanbandhit any vyay.
    • (kh) vidhan sabha ke adhyaksh aur upadhyaksh ke tatha vidhan parishad vale rajy ki dasha mean vidhan parishad ke sabhapati aur upasabhapati ke bhi vetan aur bhatte.
    • (g) aise rrin bhar, jinaka dayitv rajy par hai, jinake aantargat byaj, nikshep nidhi bhar aur mochan bhar tatha udhar lene aur rrin seva aur rrin mochan se sanbandhit any vyay haian.
    • (gh) kisi uchch nyayalay ke nyayadhishoan ke vetanoan aur bhattoan ke sanbandh mean vyay.
    • (n) kisi nyayalay ya madhyasthamh adhikaran ke nirnay, dikri ya panchat ki tushti ke lie apekshit rashiyaan.
    • (ch) koee any vyay, jo is sanvidhan dvara ya rajy ke vidhan-mandal dvara, vidhi dvara, is prakar bharit ghoshit kiya jata hai.
203. vidhan-mandal mean prakkalanoan ke sanbandh mean prakriya-
  • (1) prakkalanoan mean se jitane prakkalan rajy ki sanchit nidhi par bharit vyay se sanbandhit haian, ve vidhan sabha mean matadan ke lie nahian rakhe jaeange, kintu is khand ki kisi bat ka yah arth nahian lagaya jaega ki vah vidhan-mandal mean un prakkalanoan mean se kisi prakkalan par charcha ko nivarit karati hai.
  • (2) ukt prakkalanoan mean se jitane prakkalan any vyay se sanbandhit haian, ve vidhan sabha ke samaksh anudanoan ki maangoan ke rooanp mean rakhe jaeange aur vidhan sabha ko shakti hogi ki vah kisi maang ko anumati de ya anumati dene se iankar kar de athava kisi maang ko, usamean vinirdisht rakam ko kam karake, anumati de.
  • (3) kisi anudan ki maang rajyapal ki sipharish par hi ki jaegi, anyatha nahian.
204. viniyog vidheyak-
  • (1) vidhan sabha dvara anuchchhed 203 ke adhin anudan kie jane ke pashchath yathashaky shighr, rajy ki sanchit nidhi mean se-
    • (k) vidhan sabha dvara is prakar kie ge anudanoan ki, aur
    • (kh) rajy ki sanchit nidhi par bharit, kintu sadan ya sadanoan ke samaksh pahale rakhe ge vivaran mean darshit rakam se kisi bhi dasha mean anadhik vyay ki, poorti ke lie apekshit sabhi dhanarashiyoan ke viniyog ka upabandh karane ke lie vidheyak pur:sthapit kiya jaega.
  • (2) is prakar kie ge kisi anudan ki rakam mean parivartan karane ya anudan ke lakshy ko badalane athava rajy ki sanchit nidhi par bharit vyay ki rakam mean parivartan karane ka prabhav rakhane vala koee sanshodhan, aise kisi vidheyak mean rajy ke vidhan-mandal ke sadan mean ya kisi sadan mean prasthapit nahian kiya jaega aur pithasin vyakti ka is bare mean vinishchay aantim hoga ki koee sanshodhan is khand ke adhin agrahy hai ya nahian.
  • (3) anuchchhed 205 aur anuchchhed 206 ke upabandhoan ke adhin rahate hue, rajy ki sanchit nidhi mean se is anuchchhed ke upabandhoan ke anusar parit vidhi dvara kie ge viniyog ke adhin hi koee dhan nikala jaega, anyatha nahian.
