bhag 18: apat upabandh

352. apat ki udh‍ghoshana

(1) yadi rashtrapati ka yah samadhan ho jata hai ki ganbhir apat vidyaman hai jise yuddh ya bahy akraman ya [1][sashastr vidroh] ke karan bharat ya usake rajyakshetr ke kisi bhag ki suraksha sankat mean hai to vah udh‍ghoshana dvara [2][sanpoorn bharat ya usake rajyakshetr ke aise bhag ke sanbandh mean jo udh‍ghoshana mean vinirdisht kiya jae] is ashay ki ghoshana kar sakega.

yadi rashtrapati ka yah samadhan ho jata hai ki yuddh ya vahy akraman ya sashastr vidroh ka sankat sannikat hai to yah ghoshit karane vali apat ki udh‍ghoshana ki yuddh ya bahy akraman ya sashastr vidroh se bharat ya usake rajyakshetr ke kisi bhag ki suraksha sankat mean hai, yuddh ya aise kisi akraman ya vidroh ke vastav mean hone se pahale bhi ki ja sakegi.

(2)[4] khand (1) ke adhin ki gee udh‍ghoshana mean kisi pashchath‌‌varti udh‍ghoshana dvara parivartan kiya ja sakega ya usako vapas liya ja sakega.
(3) rashtrapati, khand (1) ke adhin udh‍ghoshana ya aisi udh‍ghoshana mean parivartan karane vali udh‍ghoshana tab tak nahian karega jab tak sangh ke mantrimandal ka (arthath‌ us parishad ka jo anuchchhed 75 ke adhin pradhanamantri aur mantrimandal star ke any mantriyoan se milakar banati hai) yah vinishchay ki aisi udh‍ghoshana ki jae, use likhit roop mean sansoochit nahian kiya jata hai.
(4) is anuchchhed ke adhin ki gee pratyek udh‍ghoshana sansad ke pratyek sadan ke samaksh rakhi jaegi aur jahaan vah poorvavarti udh‍ghoshana ko vapas lene vali udh‍ghoshana nahian hai vahaan vah ek mas ki samapti par, yadi us avadhi ki samapti se pahale sansad ke donoan sadanoan ke sankalpoan dvara usaka anumodan nahian kar diya jata hai to, pravartan mean nahian rahegi: parantu yadi aisi koee udh‍ghoshana (jo poorvavarti udh‍ghoshana ko vapas lene vali udh‍ghoshana nahian hai) us samay ki jati hai jab lok sabha ka vighatan ho gaya hai ya lok sabha ka vighatan is khand mean nirdisht ek mas ki avadhi ke dauran ho jata hai aur yadi udh‍ghoshana ka anumodan karane vala sankalp rajy sabha dvara parit kar diya gaya hai, kintu aisi udh‍ghoshana ke sanbandh mean koee sankalp lok sabha dvara us avadhi ki samapti se pahale parit nahian kiya gaya hai to, udh‍ghoshana us tarikh se jisako lok sabha apane punargathan ke pashchath‌ pratham bar baithati hai, tis din ki samapti par, pravartan mean nahian rahegi yadi ukt tis din ki avadhi ki samapti se pahale udh‍ghoshana ka anumodan karane vala sankalp lok sabha dvara bhi parit nahian kar diya jata hai.
(5) is prakar anumodit udh‍ghoshana, yadi vapas nahian li jati hai to, khand (4) ke adhin udh‍‌ghoshana ka anumodan karane vale sankalpoan mean se doosare sankalp ke parit kie jane ki tarikh se chhah mas ki avadhi ki samapti par pravartan mean nahian rahegi:
parantu yadi aur jitani bar aisi udh‍ghoshana ko pravritt banae rakhane ka anumodan karane vala sankalp sansad ke donoan sadanoan dvara parit kar diya jata hai to aur utani bar vah udh‍ghoshana, yadi vapas nahian li jati hai to, us tarikh se jisako vah is khand ke adhin anyatha pravartan mean nahian rahati, chhah mas ki aur avadhi tak pravritt bani rahegi :
parantu yah aur ki yadi lok sabha ka vighatan chhah mas ki aisi avadhi ke dauran ho jata hai aur aisi udh‍ghoshana ko pravritt banae rakhane ka anumodan karane vala sankalp rajy sabha dvara parit kar diya gaya hai, kintu aisi udh‍ghoshana ko pravritt banae rakhane ke sanbandh mean koee sankalp lok sabha dvara ukt avadhi ke dauran parit nahian kiya gaya hai to, udh‍ghoshana us tarikh se jisako lok sabha apane punargathan ke pashchath‌ pratham bar baithati hai, tis din ki samapti par, pravartan mean nahian rahegi yadi ukt tis din ki avadhi ki samapti se pahale udh‍ghoshana ko pravritt banae rakhane ka anumodan karane vala sankalp lok sabha dvara bhi parit nahian kar diya jata hai.
(6) khand (4) aur khand (5) ke prayojanoan ke lie, sankalp sansad ke kisi sadan dvara us sadan ki kul sadasy sankhh‍ya ke bahumat dvara tatha us sadan ke upasthit aur mat dene vale sadasyoan mean se kam se kam do-tihaee bahumat dvara hi parit kiya ja sakega.
(7) poorvagami khandoan mean kisi bat ke hote hue bhi, yadi lok sabha khand (1) ke adhin ki gee udh‍ghoshana aisi udh‍ghoshana mean parivartan karane vali udh‌ghoshana ka, yathasthiti, ananumodan ya use pravritt banae rakhane ka ananumodan karane vala sankalp parit kar deti hai to rashtrapati aisi udh‍ghoshana ko vapas le lega.
(8) jahaan khand (1) ke adhin ki gee udh‍ghoshana ya aisi udh‍ghoshana mean parivartan karane vali udh‍ghoshana ka, yathasthiti, ananumodan ya usako pravritt banae rakhane ka ananumodan karane vale sankalp ko prastavit karane ke apane ashay ki soochana lok sabha ki kul sadasy sankhh‍ya ke kam se kam dasavean bhag dvara hastakshar karake likhit roop mean, --
(k) yadi lok sabha satr mean hai to adhh‍yaksh ko, ya
(kh) yadi lok sabha satr mean nahian hai to rashtrapati ko,
di gee hai vahaan aise sankalp par vichar karane ke pariyojan ke lie lok sabha ki vishesh baithak, yathasthiti, adhh‍yaksh ya rashtrapati ko aisi soochana prapt hone ki tarikh se chaudah din ke bhitar ki jaegi.
[5][[6][(9)] is anuchchhed dvara rashtrapati ko pradatt shakti ke aantargat, yuddh ya bahy akraman ya 3[sashastr vidroh] ke athava yuddh ya bahy akraman ya [7][sashastr vidroh] ka sankat sannikat hone ke vibhinn adharoan par vibhinn udh‍ghoshanaean karane ki shakti hogi chahe rashtrapati ne khand (1) ke adhin pahale hi koee udh‍ghoshana ki hai ya nahian aur aisi udh‍ghoshana parivartan mean hai ya nahian. 353. apat ki udh‍ghoshana ka prabhav

jab apat ki udh‍ghoshana pravartan mean hai tab--
(k) sanvidhan mean kisi bat ke hote hue bhi, sangh ki karyapalika shakti ka vistar kisi rajy ko is bare mean nidesh dene tak hoga ki vah rajy apani karyapalika shakti ka kis riti se prayog kare;
(kh) kisi vishay ke sanbandh mean vidhiyaan banane ki sansad ki shakti ke aantargat is bat ke hote hue bhi ki vah sangh soochi mean praganit vishay nahian hai, aisi vidhiyaan banane ki shakti hogi jo us vishay ke sanbandh mean sangh ko ya sangh ke adhikariyoan aur pradhikariyoan ko shaktiyaan pradan karati haian aur un par kartavy adhiropit karati haian ya shaktiyoan ka pradan kiya jana aur kartavyoan ka adhiropit kiya jana pradhikrit karati hai : [9][parantu jahaan apat ki udh‍ghoshana bharat ke rajyakshetr ke keval kisi bhag mean parivartan mean hai vahaan yadi aur jahaan tak bharat ya usake rajyakshetr ke kisi bhag ki suraksha, bharat ke rajyakshetr ke us bhag mean ya usake sanbandh mean, jisamean apat ki udh‍ghoshana pravartan mean hai, hone vale kriyakalap ke karan sankat mean hai to aur vahaan tak,--
(i) khand (k) ke adhin nidesh dene ki sangh ki karyapalika shakti ka, aur
(ii) khand (kh) ke adhin vidhi banane ki sansad ki shakti ka,
vistar kisi aise rajy par bhi hoga jo us rajy se bhinn hai jisamean ya jisake kisi bhag mean apat ki udh‍ghoshana pravartan mean haian.

354. jab apat ki udh‍ghoshana pravartan mean hai tab rajasvoan ke vitaran sanbandhi upabandhoan ka lagoo hona

(1) jab apat ki udh‍ghoshana pravartan mean hai tab rashtrapati, adesh dvara, yah nidesh de sakega ki is sanvidhan ke anuchchhed 268 se anuchchhed 279 ke sabhi ya koee upabandh aisi kisi avadhi ke lie, jo us adesh mean vinirdisht ki jae aur jo kisi bhi dasha mean us vittiy varsh ki samapti se age nahian badhegi, jisamean aisi udh‍ghoshana pravartan mean nahian rahati hai, aise apavadoan ya upantaranoan ke adhin rahate hue prabhavi hoange jo vah thik samajhe.
(2) khand (1) ke adhin kiya gaya pratyek adesh, kie jane ke pashchath‌ yathashaky shighr, sansad ke pratyek sadan ke samaksh rakha jaega.

355. bahy akraman aur aantarik ashaanti se rajy ki sanraksha karane ka sangh ka kartavy

sangh ka yah kartavy hoga ki vah bahy akraman aur aantarik ashanti se pratyek rajy ki sanraksha kare aur pratyek rajy ki sarakar ka is sanvidhan ke upabandhoan ke anusar chalaya jana sunishchit kare.

356. rajyoan mean saanvidhanik tantr ke viphal ho jane ki dasha mean upabandh

(1) yadi rashtrapati ka kisi rajy ke rajyapal[10] se prativedan milane par ya anyatha, yah samadhan ho jata hai ki aisi sthiti utpann ho gee hai jisamean us rajy ka shasan is sanvidhan ke upabandhoan ke anusar nahian chalaya ja sakata hai to rashtrapati udh‍ghoshana dvara—
(k) us rajy ki sarakar ke sabhi ya koee krity aur [11][rajyapal] mean ya rajy ke vidhan-mandal se bhinn rajy ke kisi nikay ya pradhikari mean nihit ya usake dvara prayoktavy sabhi ya koee shaktiyaan apane hath mean le sakega;
(kh) yah ghoshana kar sakega ki rajy ke vidhan-mandal ki shaktiyaan sansad dvara ya usake pradhikar ke adhin prayoktavy hoangi;
(g) rajy ke kisi nikay ya pradhikari se sanbandhit is sanvidhan ke kinhian upabandhoan ke pravartan ko poornatah ya bhagatah nilanbit karane ke lie upabandhoan sahit aise anushangik aur parinamik upabandh kar sakega jo udh‍ghoshana ke uddeshyoan ko prabhavi karane ke lie rashtrapati ko avashyak ya vaanchhaniy pratit hoan:
parantu is khand ki koee bat rashtrapati ko uchch nyayalay mean nihit ya usake dvara prayoktavy kisi shakti ko apane hath mean lene ya uchch nyayalayoan se sanbandhit is sanvidhan ke kisi upabandh ke pravartan ko poornatah ya bhagatah nilanbit karane ke lie pradhikrit nahian karegi.
(2) aisi koee udh‍ghoshana kisi pashchath‌varti udh‍ghoshana dvara vapas li ja sakegi ya usamean parivartan kiya ja sakega.
(3) is anuchchhed ke adhin ki gee pratyek udh‌ghoshana sansad ke pratyek sadan ke samaksh rakhi jaegi aur jahaan vah poorvavarti udh‍ghoshana ko vapas lene vali udh‍ghoshana nahian hai vahaan vah do mas ki samapti par pravartan mean nahian rahegi yadi us avadhi ki samapti se pahale sansad ke donoan sadanoan ke sankalpoan dvara usaka anumodan nahian kar diya jata hai:

(k) aise sankalp ke parit kie jane ke samay apat ki udh‍ghoshana, yathasthiti, athava sanpoorn bharat mean sanpoorn rajy ya usake kisi bhag mean pravartan mean hai; aur
(kh) nirvachan ayog yah pramanit kar deta hai ki aise sankalp mean vinirdisht avadhi ke dauran khand (3) ke adhin anumodit udh‍ghoshana ko pravritt banae rakhana, sanbandhit rajy ki vidhan sabha ke sadharan nirvachan karane mean kathinaiyoan ke karan, avashyak hai:
[18]parantu is khand ki koee bat panjab rajy ki babat 11 mee, 1987 ko khand (1) ke adhin ki gee udh‍ghoshana ko lagoo nahian hogi.

357. anuchchhed 356 ke adhin ki gee udh‍ghoshana ke adhin vidhayi shaktiyoan ka prayog

(1) jahaan anuchchhed 356 ke khand (1) ke adhin ki gee udh‍ghoshana dvara yah ghoshana ki gee hai ki rajy ke vidhan-mandal ki shaktiyaan sansad dvara ya usake pradhikar ke adhin prayoktavy hoangi vahaan
(k) rajy ke vidhan-mandal ki vidhi banane ki shakti rashtrapati ko pradan karane ki aur is prakar pradatt shakti ka kisi any pradhikari ko, jise rashtrapati is nimitt vinirdisht kare, aisi shartoan ke adhin, jinhean rashtrapati adhiropit karana thik samajhe, pratyayojan karane ke lie rashtrapati ko pradhikrit karane ki sansad ko,
(kh) sangh ya usake adhikariyoan aur pradhikariyoan ko shaktiyaan pradan karane ya un par kartavy adhiropit karane ke lie athava shaktiyoan ka pradan kiya jana ya kartavyoan ka adhiropit kiya jana pradhikrit karane ke lie, vidhi banane ki sansad ko athava rashtrapati ko ya aise any pradhikari ko, jisamean aisi vidhi banane ki shakti upakhand (k) ke adhin nihit hai,
(g) jab lok sabha satr mean nahian hai tab rajy ki sanchit nidhi mean se vyay ke lie, sansad ki manjoori lanbit rahane tak aise vyay ke pradhikrit karane ki rashtrapati ko, kshamata hogi.
(2)[19] rajy ke vidhan-mandal ki shakti ka prayog karate hue sansad dvara, athava rashtrapati ya khand (1) ke upakhand (k) mean nirdisht any pradhikari dvara, banaee gee aisi vidhi, jise sansad athava rashtrapati ya aisa any pradhikari anuchchhed 356 ke adhin ki gee udh‍ghoshana ke abhav mean banane ke lie saksham nahian hota, udh‍ghoshana ke pravartan mean n rahane ke pashchath‌ tab tak pravritt bani rahegi jab tak saksham vidhan-mandal ya any pradhikari dvara usaka parivartan ya nirasan ya sanshodhan nahian kar diya jata hai.

358. apat ke dauran anuchchhed 19 ke upabandhoan ka nilanban

(1)[20] [21][jab yuddh ya bahy akraman ke karan bharat ya usake rajyakshetr ke kisi bhag ki suraksha ke sankat mean hone ki ghoshana karane vali apat ki udh‍ghoshana pravartan mean hai] tab anuchchhed 19 ki koee bat bhag 3 mean yatha paribhashit rajy ki koee aisi vidhi banane ki ya koee aisi karyapalika karravaee karane ki shakti ko, jise vah rajy us bhag mean aantarvisht upabandhoan ke abhav mean banane ya karane ke lie saksham hota, nirrbandhit nahian karegi, kintu is prakar banaee gee koee vidhi udh‍ghoshana ke pravartan mean n rahane par akshamata ki matra tak un batoan ke sivay turant prabhavahin ho jaegi, jinhean vidhi ke is prakar prabhavahin hone ke pahale kiya gaya hai ya karane ka lop kiya gaya hai:

[24][(2) khand (1) ki koee bat,-- (k) kisi aisi vidhi ko lagoo nahian hogi jisamean is ashay ka ullekh aantarvisht nahian hai ki aisi vidhi usake banae jane ke samay pravritt apat ki udh‍ghoshana ke sanbandh mean hai; ya
(kh) kisi aisi karyapalika karravaee ko lagoo nahian hogi jo aisa ullekh aantarvisht karane vali vidhi ke adhin n karake anyatha ki gee hai.

359. apat ke dauran bhag 3 dvara pradatt adhikaroan ke pravartan ka nilabann

(1) jahaan apat ki udh‍ghoshana pravartan mean hai vahaan rashtrapati, adesh dvara yah ghoshana kar sakega ki [25][(anuchchhed 20 aur anuchchhed 21 ko chho dakar) bhag 3 dvara pradatt aise adhikaroan] ko pravartit karane ke lie, jo us adesh mean ullikhit kie jaean, kisi nyayalay ko samavedan karane ka adhikar aur is prakar ullikhit adhikaroan ko pravartit karane ke lie kisi nyayalay mean lanbit sabhi karyavahiyaan us avadhi ke lie jisake dauran udh‍ghoshana pravritt rahati hai ya usase laghutar aisi avadhi ke lie jo adesh mean vinirdisht ki jae, nilanbit raheangi.
[26][(1k) jab [27][(anuchchhed 20 aur anuchchhed 21 ko chho dakar) bhag 3 dvara pradatt kinhian adhikaroan] ko ullikhit karane vala khand (1) ke adhin kiya gaya adesh pravartan mean hai tab us bhag mean un adhikaroan ko pradan karane vali koee bat us bhag mean yathaparibhashit rajy ki koee aisi vidhi banane ki ya koee aisi karyapalika karravaee karane ki shakti ko, jise vah rajy us bhag mean aantarvisht upabandhoan ke abhav mean banane ya karane ke lie saksham hota, nirrbandhit nahian karegi, kintu is prakar banaee gee koee vidhi poorvokt adesh ke pravartan mean n rahane par akshamata ki matra tak un batoan ke sivay turant prabhavahin ho jaegi, jinhean vidhi ke is prakar prabhavahin hone ke pahale kiya gaya hai ya karane ka lop kiya gaya hai :

(kh) kisi aisi karyapalika karravaee ko lagoo nahian hogi jo aisa ullekh aantarvisht karane vali vidhi ke adhin n karake anyatha ki gee hai.
(2) poorvokt roop mean kie ge adesh ka vistar bharat ke sanpoorn rajyakshetr ya usake kisi bhag par ho sakega : [30][parantu jahaan apat ki udh‍ghoshana bharat ke rajyakshetr ke keval kisi bhag mean pravartan mean hai vahaan kisi aise adesh ka vistar bharat ke rajyakshetr ke kisi any bhag par tabhi hoga jab rashtrapati, yah samadhan ho jane par ki bharat ya usake rajyakshetr ke kisi bhag ki suraksha, bharat ke rajyakshetr ke us bhag mean ya usake sanbandh mean, jisamean apat ki udh‍ghoshana pravartan mean hai, hone vale kriyakalap ke karan sankat mean hai, aisa vistar avashyak samajhata hai.]
