bharatiy parishad adhiniyam (1861) bharat ke snvaidhanik itihas ki ek yugantakari tatha mahattvapoorn ghatana hai. yah mukhy roop se do karanon se vishesh hai. ek to yah ki isane gavarnar-janaral ko apani vistarit parishad men bharatiy janata ke pratinidhiyon ko namajad karake unhen vidhayi kary se snbaddh karane ka adhikar pradan diya tatha doosara yah ki isane gavarnar-janaral ki parishad ki vidhayi shaktiyon ka vikendrikaran kar diya, jisase bambee aur madras ki sarakaron ko bhi vidhayi shakti pradan ki gayi.

varsh 1858 ee. ka adhiniyam apani kasauti par poornatah khara nahin utar saka, jisake parinamasvaroop 3 varsh bad hi 1861 ee. men british snsad ne 'bharatiy parishad adhiniyam' parit kiya. yah pahala aisa adhiniyam tha, jisamen 'vibhagiy pranali' evn 'mntrimandaliy pranali' ki ninv rakhi gayi thi. pahali bar vidhi nirman kary men bharatiyon ka sahayog lene ka prayas kiya gaya.

'bharatiy parishad adhiniyam' ki nimnalikhit visheshataen thin-

  1. vayasaray ki parishad men ek sadasy aur badha kar sadasyon ki snkhya 5 kar di gayi. 5van sadasy vidhi visheshgy hota tha.
  2. qanoon nirman ke lie vayasaray ki kaunsil men kam se kam 6 evn adhikatam 12 atirikt sadasyon ki niyukti ka adhikar vayasaray ko diya gaya. in sadasyon ka karyakal 2 varsh ka hota tha.
  3. gair sarakari sadasyon men kuchh uchch shreni ke the, par bharatiy sadasyon ki niyukti ke prati vayasaray badhy nahin tha, kintu vyavahar men kuchh gair sarakari sadasy 'uchch shreni ke bharatiy' the. is parishad ka kary kshetr qanoon nirman tak hi simit tha.
  4. is adhiniyam ki vyavastha ke anusar bambee (vartaman mumbee) evn madras (vartaman chennee) pranton ko vidhi nirman evn unamen snshodhan ka adhikar punah pradan kar diya gaya, kintu inake dvara nirmit qanoon tabhi vaidh mane jate the, jab unhen vayasaray vaidh thaharata tha.
  5. vayasaray ko pranton men vidhan parishad ki sthapana ka tatha leftinent gavarnar ki niyukti ka adhikar prapt ho gaya.

bharatiyon ka asntosh

is adhiniyam ke dvara bharatiyon ke asantosh men vriddhi huee, bharatiy janata ko vastavik pratinidhitv nahin prapt ho saka aur vidhan parishad ke adhikar atyant simit ho gaye. vidhan parishad ka kary keval qanoon banana tha. gavarnar-janaral ko snkat kalin avastha men vidhan parishad ki anumati ke bina hi adhyadesh jari karane ki anumati thi. yah adhyadesh adhikatam chh: mah tak hi lagoo rah sakata tha. vidhan parishadon men raja, maharaja ya zamindar ki hi niyukti ki jati thi. is adhiniyam dvara vikendrikaran ki niti ko protsahan mila. anek achchhaiyon evn buraiyon ko lie hue is adhiniyam ke bare men yah kahana atishyokti n hogi ki isane bhavi vikas evn snvaidhanik pragati ke marg ko prashast kiya.
